Agreement to Terms
By accessing or using AdsLair ("Service"), you agree to these Terms of Service. If you disagree, do not use the Service.
Description of Service
AdsLair provides AI-powered advertising creative generation for marketing agencies and businesses. The Service generates images and copywriting based on user prompts.
Account Registration
Eligibility: Must be 18+ and authorized to enter binding contracts.
Account Security: You are responsible for:
- Maintaining account credential confidentiality
- All activity under your account
- Notifying us of unauthorized access
Accurate Information: You must provide accurate, current information.
Subscription and Billing
- Plans: Starter ($97/mo), Professional ($297/mo), Agency ($597/mo)
- Free Trial: 14-day trial requires valid payment method. You will be charged after trial unless canceled.
- Billing: Subscriptions auto-renew monthly. We charge your payment method on file.
- Cancellation: Cancel anytime. Access continues until current period ends. No refunds for partial periods.
- Usage Limits: Each plan has monthly generation limits. Overage requires upgrade or additional purchase.
- Price Changes: We may change pricing with 30 days notice.
Acceptable Use
Permitted Use:
- Generate ad creative for lawful business purposes
- Use generated content commercially
- Share access with team members on your plan
Prohibited Use: You may NOT:
- Generate illegal, harmful, or offensive content
- Generate content that violates third-party rights
- Share account credentials outside your organization
- Reverse engineer or copy our technology
- Use the Service to compete with us
- Generate excessive requests to disrupt service
- Violate any applicable laws or regulations
Content Moderation: We reserve the right to refuse service or delete content that violates these terms.
Intellectual Property
- Your Content: You retain ownership of prompts, uploaded images, and data you provide.
- Generated Content: You own the output (images and copy) generated by the Service.
- Our IP: AdsLair's technology, brand, design, and software remain our exclusive property.
- License to Us: You grant us a license to use your prompts and data to operate the Service and improve our AI models (anonymized and aggregated only).
AI-Generated Content Disclaimer
"Quality: AI-generated content is provided 'as-is.'"
We do not guarantee:
- Accuracy or suitability for specific purposes
- Originality or non-infringement
- Compliance with specific advertising standards
Your Responsibility: You are solely responsible for:
- Reviewing generated content before use
- Ensuring compliance with advertising regulations
- Verifying content does not infringe third-party rights
- Compliance with platform-specific ad policies (Meta, Google, etc.)
No Trademark/Copyright Guarantee: While we train models to avoid infringement, you must verify generated content does not violate intellectual property rights.
Third-Party AI Services
Our Service uses Anthropic Claude (text generation) and Google Gemini (image generation). These providers have separate terms. We are not liable for their AI outputs or policy changes.
Limitation of Liability
To the maximum extent permitted by law:
AdsLair is provided "AS IS" without warranties of any kind.
We are NOT liable for:
- Lost profits, revenue, or business opportunities
- Indirect, incidental, or consequential damages
- Service interruptions or data loss
- AI-generated content that violates third-party rights
- Actions you take based on generated content
Maximum Liability: Our total liability is limited to amounts paid by you in the past 12 months.
Indemnification
You agree to indemnify and hold AdsLair harmless from claims arising from your use of the Service, violation of these Terms, content you generate or distribute, or infringement of third-party rights.
Termination
By You: Cancel subscription anytime via account settings.
By Us: We may suspend or terminate your account for term violations, fraud, failed payments, or harmful usage.
Effect: Upon termination, your access ends immediately. Data deleted per Privacy Policy.
Data Backup
You are responsible for backing up generated content. We are not liable for data loss.
Dispute Resolution
- Governing Law: These Terms are governed by the laws of the United States.
- Arbitration: Disputes resolved through binding arbitration (not court), except small claims court.
- Class Action Waiver: You agree to resolve disputes individually, not as part of class action.
